These Terms of Service ("Terms") govern your access to and use of ChartChest ("we", "us", "our") and the website at chartchest.com (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement.
2. Not Financial Advice
ChartChest does not provide financial, investment, tax, or legal advice. All analysis, signals, probability scores, and reports are generated by automated models and are for informational and educational purposes only. They should not be construed as a recommendation to buy, sell, or hold any security or asset. You are solely responsible for all investment decisions you make. Past signal performance does not guarantee future results. Always consult a qualified financial advisor before making investment decisions.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@chartchest.com if you suspect unauthorized access. We reserve the right to terminate accounts that violate these Terms.
4. Subscriptions and Payments
Pro subscriptions are billed monthly via Stripe. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods unless required by applicable law. We reserve the right to change pricing with at least 14 days' notice.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or excessively automate requests against our API
- Share your account or credentials with others
- Use the Service to redistribute or resell our analysis outputs as a financial product
- Attempt to bypass rate limits, authentication, or any access controls
Violation of these rules may result in immediate account termination without refund.
6. Intellectual Property
All content, models, code, branding, and data on ChartChest are owned by or licensed to us. You may not copy, reproduce, or distribute any part of the Service without our written permission. Your personal watchlist data belongs to you; we grant you a limited licence to export it upon request.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CHARTCHEST AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR TRADING LOSSES) ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Third-Party Services
The Service integrates with third-party providers including Supabase, Stripe, and data vendors. We are not responsible for the availability, accuracy, or practices of these third parties.
10. Governing Law
These Terms are governed by the laws of the United States of America, without regard to conflict-of-law principles. Any dispute shall be resolved in binding arbitration on an individual (non-class) basis, except that either party may seek injunctive relief in court.
11. Changes to These Terms
We may update these Terms at any time. Material changes will be communicated via a website notice or email at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
