These Terms of Service ("Terms") govern your access to and use of ChartChest ("we", "us", "our") and the website at chartchest.com (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you meet this requirement.

2. Not Financial Advice — Important Disclaimer

ChartChest is informational market intelligence software. It is not a registered investment adviser under the Investment Advisers Act of 1940, is not a broker-dealer registered with FINRA or the SEC, and does not provide financial, investment, legal, or tax advice of any kind.

All signals, scores, probability estimates, reports, scanner outputs, and other analysis generated by the Service are produced by automated statistical models and are for informational and research purposes only. They are general in nature and are not tailored to your individual financial situation, risk tolerance, or investment objectives. Nothing in the Service constitutes a recommendation, solicitation, or offer to buy, sell, or hold any security, asset, commodity, futures contract, or financial instrument.

You are solely responsible for all investment and trading decisions, position sizing, risk management, and compliance with applicable laws. Past signal output or historical model performance does not guarantee future results. Market conditions can and do change rapidly. Consult a licensed financial professional before making any investment decisions.

Market data is sourced from publicly available third-party sources including Yahoo Finance. We make no representations or warranties regarding the accuracy, completeness, timeliness, or suitability of market data. Data may be delayed, erroneous, or unavailable. Do not rely solely on ChartChest outputs when making financial decisions.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at cc14ventures@gmail.com if you suspect unauthorized access. We reserve the right to terminate accounts that violate these Terms.

4. Subscriptions and Payments

Pro subscriptions are billed monthly via Stripe. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods unless required by applicable law. We reserve the right to change pricing with at least 14 days' notice.

6. Intellectual Property

All content, models, code, branding, and data on ChartChest are owned by or licensed to us. You may not copy, reproduce, or distribute any part of the Service without our written permission. Your personal watchlist data belongs to you; we grant you a limited licence to export it upon request.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE EXPRESSLY DISCLAIM ANY WARRANTY THAT SIGNALS, SCORES, OR MODEL OUTPUTS ARE ACCURATE, RELIABLE, OR SUITABLE FOR ANY TRADING OR INVESTMENT DECISION. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. MARKET DATA IS SOURCED FROM THIRD PARTIES AND PROVIDED WITHOUT ANY WARRANTY OF ACCURACY OR TIMELINESS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHARTCHEST AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING WITHOUT LIMITATION ANY TRADING LOSSES, LOST PROFITS, LOST DATA, OR OTHER FINANCIAL LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE). OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Third-Party Data and Services

The Service sources market data from third parties including Yahoo Finance. Market data may be delayed, inaccurate, incomplete, or unavailable, and we are not responsible for any losses resulting from reliance on such data. We are also not responsible for the availability, accuracy, security, or privacy practices of other third-party providers we integrate with, including Supabase, Stripe, and Render.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States of America. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. You and ChartChest each waive any right to a jury trial or to participate in a class action, class arbitration, or representative proceeding. If the class-action waiver is found unenforceable, the arbitration agreement shall not apply and the claim shall proceed in court.

11. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via a website notice or email at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.

12. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChartChest regarding your use of the Service and supersede all prior agreements, understandings, and representations, whether oral or written.
